Terms and Conditions
1. Payments – Payment is due at time of session, unless a different payment schedule is discussed with Intential.
2. Hand Editing Policy - Intential reserves the right to edit and release only the images that are deemed creditable as professional in quality and within Intentials’s standards. The photographer enhances photos via corrections to contrast, lighting, and color, as well and skin smoothing, eye brightening and teeth whitening, etc. Intential does not change any inherent qualities of a person.
3. Hand Editing Limitations - CLIENT acknowledges that there is a limit to the total number of hand edited images included in different packages. Minimum number disclosed to client based on which package they schedule with Intential.
4. Delivery of Finished Product – Intential will provide digital photo(s) to the client via an online album. Photo(s) can also be delivered on a USB jump drive at an additional cost. Online Gallery will be available within a reasonable timeframe based on the level of service. Weddings & large events may take up to 8 weeks for delivery. Most sessions are available 14 days from the stated service unless Expedited Editing Service is selected.
5. Digital Files – Where the digital files (negatives) are included with the package, you agree to assume full responsibility for the care and condition of said digital files. Intential recommends storing copies in several locations, including off site storage. Intential is not responsible for the color reproduction of enlargements from these files that have been taken to non-professional and/or consumer type labs. Intential will keep a copy of these files at his/her discretion. Requests for additional and/or replacement copies of these files will incur an additional cost.
6. Online Gallery - Online gallery galleries will be available online for a maximum of 30 days after CLIENT is provided access. Customer should download all images prior to gallery expiration to avoid gallery enablement fee.
7. Late Policy – We allow a 10 minute grace period for clients running behind schedule clients arriving within this time period will still receive their entire session length. In the event the client is more than 10 minutes late, the session will be rescheduled after payment of a $50 late fee. In the event CLIENT elects not to reschedule, the session will be cancelled. See cancellation policy in section 11.
9. Copyright/Usage – Intential will retain the copyright of the photographs and permission is hereby given for Intential to use these photos for future advertising, studio display, competition, exhibits and/or reproduction.
10. Exclusive Rights – It is understood that Intential is the exclusive Official Photographer retained to perform the services requested in this contract. Additional photography (camera phone, etc.) is prohibited during the session.
11. Cancellation – In the event of cancellation, Intential will retain 50% of monies as cancellation fee. The remaining balance will be returned to the client.
12. Rescheduling Policy - Sessions can be rescheduled no less than 48 hours prior to session date. In the event client needs to reschedule less than 48 hours before session, Intential will assess $25 rescheduling charge. Rescheduling charges and session fees must be paid prior to rescheduling the session. If client wishes to cancel the session: see cancellation policy in section 11.
13. Studio Liability – Intential will take the utmost care with respect to the production, post-production, and delivery of the photo(s). However, in the event Intential fails to comply with the terms in this contract, due to any event or act outside the control of Intential, is limited to the amount paid.
14. Bodily Harm - Client acknowledges that Intential is not liable for any bodily or other harm incurred by client and, if applicable, minor child(ren) during photo session due to negligence or other risks inherent with onsite or studio photography.
15. Fees – an administration fee of $25.00 will be applied to returned Checks.
